Taken directly from BOS website.
Assess
Make a judgement of value, quality, outcomes, results or size

So yes, essentially talking about the effectiveness as when you do that, you are making a judgement.
I made sure to say that "therefore, the role is discretion is both important/crucial and highly effective/ineffective in (topic of paragraph).

Make a judgment
RESPONSIVENESS (What was the response from the law?)
ACESSABILITY (How accessible is the law?)
RESOURCE EFFICENCY
ENFORCEABLILTY (No law is a good law if it is not enforceable)

MEETS COMMUNITY EXPECTATIONS
APPLICATION OF THE RULE OF LAW (How is the rule of law applied?)
PROTECTION OF INDIVIDUAL RIGHTS (How has peoples individual rights been applied?)

HAS JUSTICE BEEN ACHIEVED?

Or RARE MAP as our teachers taught us!

Effectiveness was a part of it, but it was also to show how entrenched/ involved and important discretion was

I think the focus in this instance was to actually assess using modality terms (ie. pivotal, crucial, paramount, significant, etc.) rather than in the options section where, for example, the family essay asked you to explicitly use the effectiveness criteria (ie. RAREMAP - thanks paul95!).

Anyway, what's done is done. There's no need to worry now - just focus on acing everything else!

Good luck to all fellow Legal BoS students!

there's no effectiveness criteria for the new syllabus. you evaluate it according to whatever seems appropriate.
