So I was under the impression that they don't have access the family court but instead get the same rights through the district court.

Though a set of reliable notes in front of me tell me that the Family Law Amendment (De Facto Financial Matters and other Measures) Act 2008 (Cwlth) allows equal access to the family court.

Same Sex Couples can access the federal family court for matters regarding property for example, and that legislation allowed for that.
