From The Mutual Assistance In Criminal Matters Act 1987 (Cth) Section 8:

(1A)
A request by a foreign country for assistance under this Act must be refused if it relates to the prosecution or punishment of a person charged with, or convicted of, an offence in respect of which the death penalty may be imposed in the foreign country, unless the Attorney-General is of the opinion, having regard to the special circumstances of the case, that the assistance requested should be granted
I'd like to know why ruddock thinks this case has special circumstances, why are the AFP helping with the investigation when the death pentalty is so obviously on the table, why werent these people arrested in Australia, why is the govt letting them face the death penalty? does the government really oppose the death penalty?

Discuss.

Hmm I dunno, if the A-G is trying to help gather evidence that he believes could HELP the bali 9 (such as information about ring leaders etc), then I think this is fine and it shows they oppose the death penalty.

But the idea that our country could be helping to gather evidence to convict our own people to death in another country is disgusting, and wrong. Unless this information in some way leads to saving other people's lives (which it wouldn't in this case).

are you sure there isnt any other laws ---that over ride this one though..?????.

but yeah a drug charge ---------isnt special circumstance........thats the smalllest of matters...

maybe a fucking terrorist attack or something --------maybe that could constitute special circumstances...

but not this..........

if there is no over riding law...........and our govnerment is breaking the law ----------lets have the police arrrested and shit....it will never happen though...

our government and police are above the law.

Im not saying in this case they have.....there could be altetnativbe laws that over ride this.

but lets look into it............

Really if Corby dies, it wont be that significant. This will not be remembered in the history books.

it is important, actually. i'm sorry, but, this is just the first step in a government that is gonna disregard human rights totally, and fail to protect it's citizens

It will matter in the short term as she is likely to be innocent, but in the grand scheme of things it is a mere punctuation mark

i recon they think she is guilty but they might let her offf cos of pressure.

maybe the government handed over the bali 9 in exchange for her freeedom?

i recon they think she is guilty but they might let her offf cos of pressure.
They are under alot of pressure to keep intact the laws that stop drugs from entering our country.

If they say she is innocent on grounds there is no proof that she put the drugs in the bag, that means many more will be innocent over lack of evidence.
