Ok Ziffs not here so I'll start by doing half your essay question and Ziff can finish the rest or elaborate on my points because he is smart.

1_ Mitigating, aggravating, subjective and objective factors.

2) Incapacitation is probably the only reasonable punishment

3) Making Sam incapable of offending. Purpose is to protect community from offender.

4) That is subjective and up to you to decide. Major heading could include the following:


-Equality (cost, time,knowledge, enforceability, resource efficency)
-Balance of individual and community rights
-Reflection odf standards anmongst community
-Opportunities for appeal and review
