Difference between a suspension and disqualification? (1 Viewer)

I was caught driving a prohibited vehicle on the 12th August

I got an exemption letter to drive THAT prohibited vehicle on the 18th August

My licence was SUSPENDED (see point 1) for a period of 3 months on the 6th December

On my exemption form (see point 2) it says: "This exemption letter is null and void if you are disqualified from driving and/or your licence is cancelled"

Does that mean that when I get my licence back on the 6th March, the exemption is null and void? Or does a suspension differ to a disqualification and licence cancellation? If so, how?

No, they are different things. It is telling you that if you are caught doing something even more illegal and they take your license for good (i.e. disqualified) then the notice would become null and void because it would take so long to get your license again that the notice wouldn't even matter.

I'm not sure if I agree with your interpretation Aquawhite (but forgive me if you actually have experience in this). My understanding is the exemption letter is voided the moment you are caught doing something which warrants a suspension but then the RTA website implies that disqualification can only be handed down by the courts (http://www.rta.nsw.gov.au/rulesregulations/penalties/licencedisqualification.html).

Chromatic, I suggest you ask the RTA yourself about this as it'll be the only way to find out with any surety.

I think that's what I was attempting to say; I don't have experience with anything like this so we'll go with your definitions.

I dont think so, but I'll find out from the RTA to know for sure.

You know how you get the 1 passenger condition if you are DISQUALIFIED? Im not getting that condition because im not getting my licence re-issued. Im sure they're different things.

suspended is just when your licence is suspended, you still keep your licence and can start driving again after the suspension period



if the letter says disqualification then thats what it means. a suspension wont affect it. the RTA would have specifically said suspended as it is an RTA term and differs in meaning to disqualification.

Not that anyone cares, but I've been pulled over about 5 times since getting my licence back and my exemption is still valid, thanks for all your help guys
