i think that if it was in black and white and the subject (the person, if you didnt know) wasn't looking at the camera and enjoying the atmosphere thats around him. the more natural the subjects look, the more artistic it becomes because then you really have captured the moment.
otherwise, it looks staged.
black and white pictures can really give a shot depth and a mood, which is why i suggested that as well.
