This is quite a simple question - but i'm pretty anxious cos i have a torts exam coming up. Basically i want to know if diminution in land value is an element in private nuisance liability. I can't seem to reconcile two cases in particular : Laws v Florinplace [1981] 1 All Er 659 in which the main reason for liability seemed to be diminution of land value and Victoria Park Racing and Recreation Grounds Co v Taylor (1937) 58 CLR 479 in which diminution was considered but not given much emphasis. Thanks in advance to anyone that can help!
