Court dumps 'annoy' law

Two Sydney activists have won a Federal Court challenge to special World Youth Day laws which carry $5500 fines for annoying or inconveniencing pilgrims.

NoToPope Coalition members Rachel Evans and Amber Pike took the NSW government to court over the police powers granted for the month of July seeking a declaration that they were unconstitutional.

Justices Catherine Branson, Robert French and Margaret Stone today ruled the specific clause relating to annoying and inconveniencing pilgrims went beyond the intention of state parliament.

In 2006, the parliament passed the World Youth Day Act which allowed the World Youth Day Authority to pass the annoyance clause in 2008.

In dismissing the other points of the coalition's claim, Justice French found that parts of the act banning the sale of certain items including stickers, badges and T-shirts did not infringe upon the right to free political communication.

However, the judge said the annoyance clause was invalid because it could not have been the intention of parliament to make such vague and extensive limits to free speech.

The court said the law was intended to encourage policing and public safety but could be misused to infringe on people's rights.


However, the court dismissed the second part of the university students' challenge, upholding the section of the regulations that said prescribed items could not be distributed. It said banning the unauthorised sale of certain items, including stickers, badges and T-shirts, was not unconstitutional and did not stop free political communication. The judges said the No To Pope Coalition would not be prohibited from handing out condoms and leaflets under the laws.

Glad with the result but there is fairly similar legislation already in existence and I'm sure they could potentially use it against WYD Protestors... Also will be interesting to see whether the Government takes this to the High Court.

Most people I spoke to saw him as a twat; he was asked not to cross the road and did anyway, and was treated accordingly.

They will be viewed as no good trouble makers that probably should be arrested. People need to see an older, middle class person being victimized by abuse of authority. Actually the guy that was beaten by police during APEC for crossing the street was a good example.
the people that matter DO NOT CARE, that's why our civil liberties have been slowly eroded at state and federal level for years with minimal complaints (and anyone who does is portrayed as a hippy by the murdochitler press)

NSW Police Commissioner Andrew Scipione said the decision would have no impact on policing of World Youth Day events.
