someone thats 1st in a class of 12 students got the second highest external mark at around 70/100 and the person thats 5th in the class got the highest external mark of like 92/100 would the highest mark be given to the student that came first or do they both get the same high mark?

The 5th ranked internal student will get the 5th highest external mark from the HSC. Would not get that 70 necessarily. It would be much less than 70 (since that was 2nd).
This may seem unfair but it's how the system works I believe, so pretty much reflects on the work you've done throughout the year.

It's either that or the bell curve theory lol. I'm not sure which one is correct but both seem reasonable.

yep 1st ranking gets a 70 external + 92 internal, which becomes 70 + 92 / 2 = 81

The person who is first will get the 92/100 as they are placed highest, but that score will be combined with their 70. So roughly, they will get 80-81.
As for the 5th placed person, they get the 5th highest mark in the externals (so it depends on the 3 next highest marks in the cohort) and that will be combined with their 92 external mark. Let's just say that the 5th highest was 80, then the 5th person will receive roughly 86
