    The Official Schapelle Corby Thread™

I take your point One thing though. Suppose she is a drug smuggler and was trying to import drugs into the country, for whatever reason. How are they supposed to prove she had knowledge of the drugs if there is no presumption that whatever was in the bag, she was aware of, or was hers? It...

Perhaps not soley on that fact - there was evidence that she was acting nervous or shifty and went white or some such behaviour as well. But using common sense, shouldn't the fact that the drugs were in her bag put up a small presumption that whatever was in the bag did belong to her? For...

    The official IR reform thread!

The ACTU has said it will challenge the legislation, which could be very exciting! It would involve a battle in the High Court over whether the legislation is within the powers of the Commonwealth. Although I highly doubt the legislation would be unconstitutional... as I understand it the...

    The official IR reform thread!

These are the main parts of the reforms: • Exempting businesses with up to 100 employees from unfair dismissal laws • The establishment of a new fair pay commission to set minimum wages, currently set by the Industrial Relations Commission • A simplified award system that would no longer...

Breaking News: Schappelle Corby found guilty!

It is, but at the same time there is the "golden thread" that ties the criminal justice system together, the very foundations of our criminal process: innocent until proven guilty.

Breaking News: Schappelle Corby found guilty!

I'm not saying Australian law on drugs is good - indeed I disagree with many of the NSW deeming provisions

    The Official Schapelle Corby Thread™

In Australian law with regards to proving she had possession, yes, they would have to show knowledge of the drugs being there or awareness of the probability of the drugs being there. This knowledge can be inferred, based on evidence provided by the customs official of her nervousness, the fact...

    The official IR reform thread!

lol Though the unfair dismissal laws will only cease to apply to business of 100 people or less, so he won't be too happy :P

Breaking News: Schappelle Corby found guilty!

You obviously don't have any knowledge of the Australian drug laws. The onus is substantially reversed in Australia as well.

Breaking News: Schappelle Corby found guilty!

Importing drugs is not a petty crime, but I do agree that, Australian law or not, 20 years is quite harsh. I have no idea whether she is at fault or not, but I think there would be a considerable chance of her being found guilty if she were tried in Australia, at least for possession.

    The official IR reform thread!

I know. The amount of activity on the forums with regard to Corby compared with IR probably reflects the distraction of the Australian public. It's unfortunate -- whether the IR reforms are good or not, it is an important issue and event that people should be aware of

AG Philip Ruddock has indicated that virtually all agreements to serve sentences in other countries involve the same length of prison sentence. So if she is sentenced to 10 years over there, it is 99% certain it will be 10 years here.

    Favourite High Court Justice

I don't think he "makes more sense". You could make the argument he uses more "common sense" maybe. Despite being the most difficult to understand (in my opinion), Gummow is widely regarded as the intellectual heart of the HC

    The Official Schapelle Corby Thread™

What irritates me is those who say that in these circumstances Australian law is so much fairer and more lenient. There's a bunch of local criminal solicitors, for example, in the Manly Daily, saying it would never have gone to trial - then they mention how the defence hasn't proved her guilty...

    Is Law Boring?

Personally I've found the class sizes at UNSW to be appropriate and have never had a problem with it. The socratic method is not crap. It is a tried and proven tool for effectively engaging with students. If students won't speak up or communicate in class then it's their own fault. They're going...

    Is Law Boring?

Well law is a very useful discipline which helps in many fields, especially business. But you will have to spend two extra years at uni and time studying something that you may not like very much, and which you may not do well in, if you really don't enjoy it. By the time you've finished your...

    Is Law Boring?

Now now, they're not idiots :P Though it's a good thing to have a go at, it's not for everyone. I know some very clever people who are particularly good at law who just don't like it - some just aren't competitive people or oral argument isn't their strength. (There are also a lot of really...
