As long as you maintain the overall diameter then you maintain the speedo calibration (and minimise possibility of scrubbing) and hence can not be defected.

You can be defected if you widen the track - that is if you increase the distance between the centre of the wheels on each side. However this is not generally noticeable eg the track on my volvo is 20mm wider than stock however I have not been defected. To stop this happening you need to use mags that have the same offset to the stock wheels, you're mag/tyre dealer can help you with this.

And if for some reason you do want to widen the track then its really not hard, you will just need to flare the gurads out in some manner to cover the tyre and get an engineers certificate which should be ~$500.
