Legal Assignment Help (urgent)

What is meant by legal h.rights protection mechanism and enforcement mechanism?

Also what methods are there of enforcing h.rights (which is the most effective and why?)

Seriously, i'm gonna give you a wake up call. NEVER leave an assignment to the last minute and asking for help in a forum. you will not get into the habit of it when it really counts (next year) and even if you do well you will have to live with the consequences that if only you weren't so lazy then you could have done much better.

Anway, very briefly HR can be protected in the following ways:

Domestically:
Statutes, The common law, and Bills of Rights

Internationally:
Conventions and Multilateral agreements


In terms of enforcement, the following can apply:

Sanctions
Moral: The demonstration and expression of opinion
Political: The termination of formal diplomatic relations
Economic: Trade blockades
Financial: Refusal of loans and the withdrawal of aid.
Physical: War

i'm not too sure about non legal human right enforcement mechanisms, never heard of it to be honest. but i just checked my stupid text book, and it might have something to do with the recognition of customary rights of indigenous Australians and how the courts are becoming more willing to enfore them.

example from my text - 'Legal Studies HSC' Hamper Derwent Draper (Pearson and Longman)

'In the case Yanner v. Eaton [1999] HCA 53 the High Court of Australia agreed with Mr Yanner that he had a customary right to hunt crocodiles. This customary right overrode Queensland legislation requiring a licence to hunt crocodiles.'

hoped that helped. good on you for getting things started early, might have to try that sometime :)

Hey CINDY my assesment is quite odd

Ive found the article "Technology not Kyoto the key"

It talks about the use of technology (non legal) to reduce gas emissions and all that crap relating to the environment instead of the Kyoto Protocol (legal)

Therefore would that demonstrate a non legal h.rights enforcement mechanism

wow i was WAY off. you are right, that is odd.... but it seems like ur on the right track now.

all i had to do for mine was research human rights around the globe, pick like a specific question/ area and present it in a group to the class. our group did 'compare the effectiveness of the government in protecting women's human rights in Australia and Iraq'. relatively simple...

good luck!

i was just a bit confused about a dot point we were given for our assignment:
Identify the nature and extent of the human rights being violated...
does this just mean to explain how bad they are or what?

The nature part means you have to explain the human right being abused

AND

The extent (the measure) to which the h.rights issue is being violated i.e how badly is it being abused?

Does that make it clearer?
