evaluate the implications of plea-bargaining for the notion of justice

While plea-bargaining speeds up the process of justice saving time and money, it however, makes a mockery of the term justice. When someone does plea-bargaining it does not allow for justice to be served as one could get a lower sentenced, be charged with a lower crime or even be pressured into taking one when they are innocent.

You will have to way up the pros and cons in relation to justice. Yes it saves money and time, but it does undermind the concept of justice. Try reading this: http://www.abc.net.au/4corners/content/2004/s1181266.htm

Hope this has helped

Plea bargaining involves the accused pleading guilty to a lesser offence or to one of a number of offences. The Department of Public Prosecutors may bargain the charge down or the accused may change their plea to guilty if they are faced with an unwinnable case. Benefits for plea bargaining is that there is the decrease in court costs and delays however the offender may not be receiving the punishment they truly deserve, which makes the victim feel unjustly treated.

so justice can have 2 perspectives. for the accused, they see that justice is present as it has allowed the accused to suffer a less harsh punishment while as for the victim there is the lack of justice within the legal system
