You think a case assignment is bad
I've got a 4000 word essay on whether the war in iraq is legal or not due this friday :chainsaw:

I've already done a case assignment and it seemed to be much easier, extracting the ratios and stuff, maybe its just because I don't know how to start the essay :(

Btw, does anyone here know what customary international law is (or customary law in general) and whether it's considered natural law or positive law?

...so where does customary law come into it and is it a part of positive law or natural law?

no newbie u fool!

what the hell haven't you been listening to mehera at all :(

right of action --> whether you have a cause for the claim you are bringing, which might include assault, negligence, breach of contract, conversion, etc

for eg. "dacking" is not a cause of action

darhghgh

its all too confusing
gault goes LETS MAKE A RIGHT OF ACTION FOR PRIVACY
but then he puts the whole bit into the heading Elements of the Tort

and damn those two dissenting dudes, especially anderson who just talked randomly for 10 paragraphs.

ahh mehara, please give me something more than zero for class participation

back to the original question,
I know a couple of friends have transferred from B.Com to Law this year, their UAI's were in the 97/98 range, and they had at least a distinction average

Yeh Gault P says that there should be a cause of action for invasion of privacy, then he goes on to say what elements would need to be satisfied in such an action.

I know its annoying - I get the image of Anderson J being some old waspy conservative dude. But they are making clear that freedom of expression is really important

...you should put this in another thread...

Just to clarify on those previous comments... the existence of the tort itself gives rise to a right of action.

A tortious act on the part of the defendant then allows the plaintiff to pursue that right of action.

I've been trying to think of an analogy... the tort creates a (closed) doorway, which is a right of action in potentio. The tortious act opens the doorway, allowing the right of claim to pass through. Where there is no tort, it doesn't matter whether the doorway is open or closed, because there's no doorway to begin with - and hence no right of action (under tort law).
