does anyone know if its illlegal for ppple to discriminate against u based on an irrelevent criminal record.

Like i heard drug/voilent crimes are pretty much irrelevent when it comes to employment........does anyone know anything about this.


is there any time limit......when a criminal record runs out for employment purposes???

anyone had any experience? or know anything abut this..

I'm pretty sure employers don't have to employ you if you have a criminal record. Why? Are you worried about something?

Criminal records and NSW public sector employment

Criminal record checks for positions advertised as “public sector positions” are covered by chapter 2-15 of the Recruitment and Employment Guidelines in the Public Service Personnel Handbook. Other government positions may follow similar guidelines. The Guidelines say that checks should only be performed on the candidates who are to be offered positions. Generally, checks for convictions, other than sexual convictions, will only go back 10 years, but the Guidelines do not explicitly state this. Minor offences more than 10 years old may be spent convictions. However, even spent convictions must be disclosed when applying for certain positions of trust: legal officers (judges, magistrates), police officers, prison officers, and teachers.

The Guidelines give you an opportunity to discuss any conviction, usually with the human resources manager of the department before a final decision is made. Before a decision is made the department is to consider a number of circumstances, including the age of the conviction, your age at the time, number of convictions, the sentence imposed by the court and any extenuating circumstances. You could also give the department any positive character references from responsible people who are aware of your conviction.

tattoedguy, even though it may be discriminatory (and sometimes, illegal) you ca'n't do much about it because the burden of proof is on yourself...and usually things like that are very hard to prove...the employer may avoid any serious reprucussions by explaining that you were not the best person for the job...

I was thinking like ------------------if someone does a crime and has a record.............................its sort of stupid............to..not tgive them a job etc..........like..........then they will just commmit more crimes cos they cnat do anything else..................what do you guys think?

we all fuck up from time to time.. ppple shoudlnt have to pay for something there hole life.........espeically.......over some bulll shit. It should be ..u do the crime..u do the time.............case closed.........unlesss u have very serious charges....or something..........................or several charges etc..........i dont think...........anyone in the world besides the police shoudl be able to access ur crim record.....................something like that anyways.

Especially if you got 1 or 2 or 3 shitty little charges.........after 2 years...to the public they should be ..............abolished.....

A criminal record will only make you unsuitable for only some jobs. If you've been busted for petty theft long ago, employers would ignore it. They wouldn't employ you to, say, be a cashier if you've had a recent history of theft. If you've got a recent history of unprovoked violence, they won't hire you as a sales assistant. If your crimes aren't severe, and aren't fresh, employers usually won't discriminate against you.

so if you were an employer, you wouldnt have a problem employing someone who had a violent history of assault? hmmm.....

CPA is right. Isn't CA chartered account? Those are the two main groups of accountants.

honestly, i wouldnt really care especially if it was just a one offf event.

Alot of ppple on assult charges, are just standing up for them selves etc.

I dont have a problem with people standing up for themselves. Alot of ppple who get hit deserve it, i gues it would depend on the situation.
