Effectiveness of legal and non-legal measures in achieving justice (1 Viewer)

It's a theme & challenge that's bound to pop up in one of my trial papers. It's on Crime, and I know that it's a pretty broad question but I would be beyond grateful if anyone else could give me a hand in a few of the points in this.

With such a broad question you really want to pinpoint just a few strong points to make about the effectiveness of the system. The best points to explore are those in the system that through the years have been the most controversial. This includes:

• Police powers (right to silence effectively taken away)
• Bail/remand
• Plea bargaining
• Use of defences (esp. provocation)
• The jury
• Mandatory sentencing (life for killing a police officer)
• Effectiveness of certain punishments (esp. imprisonment)
• Can incorporate stuff from young offenders

When evaluating the effectiveness of these areas, it is important to use various criteria. This can include:

• Resource efficiency
• Protection of rights
• Access
• Equality
• Enforcement
• Reflecting societal values
• Opportunity for appeal

Also, don't forget to incorporate appropriate statutes, cases and some media articles
