What legal defences would a content host have for hosting racist material (in this case a game)?

From my understanding these are the expemtions and none of them seem to offer any defence to this particular situation:

(a) in the performance, exhibition or distribution of an artistic work; or
(b) in the course of any statement, publication, discussion or debate made or held, or any other conduct engaged in, for-
(i) any genuine academic, artistic, religious or scientific purpose; or
(ii) any purpose that is in the public interest; or
(c) In making or publishing a fair and accurate report of any event or matter of public interest.[117]

unless a racist game is considered artistic?


Would it be something like innocent dissemination or is that only for defamation?

but seriously does anyone have an answer or is this just a stupid question?

"imagine you are a content host in australia, what defense or defences would you use to defend the contents of this site (in reference to a site with racist content)"?

If I could do it I wouldnt be here asking. Cmon just give us point in the right direction...I've read the whole book and I still have no idea :S

Has it got something to do with the Racial Discrimination Act not covering private internet communications?
