How are human rights hindered under Australian and International Law?

That was one of our revision questions for half yearlys, having trouble finding the answer. There was another question basically the same on state soverignty, so I'm assuming that isn't what its asking (would that be one of the answers normally?)

For Australian Law look maybe specifically into:
-Conventions on the rights of a Child (CROC)and detainment of child refugees
In the CROC, it states children should be detained as a last resort whereas in cases of detainment of child refugee, it is the first resort. Thus argubly state sovereighty in this case allows Australian law to act against the rights of a child which is an important aspect of human rights.

-Can also argue that Australia lacks a Bill of Right, thus not everyone knows what they are entitled to. Some rights that are not stated within the Constitution can be easily removed etc.

As to International Law refer to its' "soft" nature, which means there are no definite enforcement of human rights. It is virtually up to nations to agree upon conventions. e.g. USA and Somalia are not signatory nations of CROC.

EDIT: And yes State Sovereignty is a valid point.
