I'm not quite sure how to start the assignment. How are we supposed to answer the questions? The first question is about establishing a duty of care and then the second is how it was breached? How do we apply the four step negligent test?

is there duty?
answer: in case xx, this was the decision/material facts
in our case the material facts were/were not similar to case xx
therefore there is/is not duty. etc..

is there breach?
is there causation?
is there remoteness?

(if I remember correctly)

Use Donaghue v Stevenson and related cases for establishing a duty of care.
It seems to me that the 4 step test has been broken down by the questions (ie 1 step is the first q, second step is 2nd q etc)

more specifically to the assignment (as im doing it too :p) about public authorities
1. section 40-46 of CLA 2002.
2. reasonable foreseeability ?
3. able to protect a specific class ?
4. plaintiff vulnerable ?
