Next week we're going to discuss a tutorial question based on the Donoghue v Stevenson case. Here are the questions relating to the case. In brackets are my queries for each question.
1.) How many precedents did Lord Atkin refer to? Why did he review these precedents? (Do i just count the amount of cases he refers to?)
2.) How do the views of Lord Buckmaster differ from those of Lord Atkin? (I've read the extract, but i'm not sure as to how their views differ)
3.) Did Lord Atkin require a defendant to avoid all injury to any people? (I can't find the answer to that)
4.) What test does the court apply in deciding whether a defendant should be liable for any particular injury? (Does this refer to the "Neighbour test"?)
5.) Was Stevenson found to have been negligent? Explain how this case ended. (Yes, i think so. Is this right?)
