say you come first in a subject, and during the external exam...a person gets the highest mark which will go to the person who came first....say that mark is 85 and your assessment mark is 95....will you receive this mark as your assessment mark? and hence will you be scaled down? how does it work when the highest mark achieved in the grade is LOWER than the internal assessment mark obtained by the person ranked 1st.

Just means that you had easy internal assessments or easy marking, and as such moderation will have done its purpose, even out the different school's assessment marks. In this case, if you were ranked first and the highest exam mark in the external HSC exam was lower than your internal assessment mark, it would mean that you would get the external HSC exam mark as your HSC assessment mark, not your internal assessment mark, even though it is lower than your internal assessment mark.
