It is just me or was there no or seldom mention relating to the "50 year old" segment of the question?

Evidently, the law aims to maintain the triats of justice and equality, however, depending on the circumstances, individuals involved in the criminal justice system cannot be treated in EXACTLY the same manner.

A 17 year old and a 50 year old would not maintain the same frame of mind, the prosecution must determine the mental health of the accused at the time in question for one requirement and work from that.

So no they would not be treated the same. Although, general rules of precent obvioulsy apply.

The charge would be the same as per the Crimes Act which has already been stated. However, at sentencing the judge would take into account mitigating factors such as the age difference of the offender, possible statements of will from the vicitm (if u can call her that) etc etc obviously every case is sentenced on its own merit. However, i am imagining that a 50 year old would be sentenced much much harder however im in my first year and hence my opinion = shit.

The age of consent is 16. It is absolute; u dont need to ask 'what if' questions. Whether it is ethical or not, well thats not really in debate. It is just as legal for a consenting 16 year old to sleep with her 18 year old boyfriend as it is for a consenting 16 to sleep with a 65 year old rock spider. As scary as that is (and assuming he doesnt owe her a duty of care through guardianship/teacher/tutor etc) that is what the law allows.

hey guys,

ok umm at the beginning of this year, im in yr 12, we had a ex-policeman come talk to all the boys of our grade as some kind of informative talk about date rape, binging etc.. anyway, he mentioned the fact about sleeping with younger girls/boys. he said tha in numerous causes that he had encountered first and second hand that if a say 17 or 18 year old boy was found to be having sex witha 16 year old girl, provided there was consent from both, the police would not press the issue unless the parents really wanted to go on with it.

i think obviously as the age gap increases the severity of the crim will also..but not just sex...there are countless crimes in america for example where 17 year olds are tried as adults, but as mentioned if it reaches that level then it is the judges disgression.

but yeh thot i would just share wat my experience wit the cop.

ok if 16 does not equal illegal, his main point was that if the children are nearer in age e.g. two 15 year olds, then the policeman does hav input into the case, in the form of wether it reaches court at all. But yeh this is quite a volatile issue, can be argued either way i guess.

Mate, there's no two ways around it. If the victim chooses to press charges, the police are forced to investigate and The Crown WILL take the case to court, provided that the judge in the preliminary hearing decided that there is a case to answer to.

the only input the cop has is to arrest them and maybe charge them, but once they're charged it goes to a prosecutor, and man i seriously don't think there are many prosecutors who would make a case against two 15 year olds

also stat rape is harder to prove than normal rape. if you have two consenting people, and the person making the complaint is say, the mother... then you have a burden of proof. unless you can get the younger partner to make a statement against the older partner, it's pretty hard to make a case against stat rape especially when the ages are so close

not to be said it cant be done, but it's hard

That's true, the case most probably would buckle and collapse if the victim refuses to make a statement or cooperate.

i knew of this couple out here. she was 15, he was 17. they had a kid together by the time she was 16 and evrything was peachy. something went wrong and they broke up, and she accused him of stat rape 3 years after the fact.
so naturally he got charged coz the proof was there (a baby at 16) and now he has no access to the kid.

she's a vindictive bitch and it's unfortunate that she did this, but meh

What punishment did he get? Was it only that he never got to see his kid again?

no we had to do weekend detention for a while and has to pay child support
he from all accounts was a nice guy, no abuse, very involved in the kids life. worked hard.
