Serious Post: I'm very skeptical of the whole tough on crime approach and calls for draconian sentances, but in this case WTF! This really is an appaling failure by the courts. The idea that a 10 year old can meaninfully consent to sex with several older men is absurd.

A year! I'm thinking an appropriate sentance would be at least 10.

It is not appropriate to depart so significantly from established standards because a judge predicts that it may be preferable for that particular aboriginal community. There are certain minimal standards that need to be upheld through the state even if they result in poor outcomes when applied to a particular case.

For instance, if someone who would otherwise be convicted is aquitted because key evidence is inadmissable, an injustice occurs. However, it is necessary for this to occur to maintain an overall standard that certain requirement be adhered to when obtaining evidence. This protects the whole community, not just those in this particular case.
