Authorities have been accused of creating a "time bomb" by not ordering an eight-year-old boy allegedly involved in the rape of a three-year-old girl to undergo some form of counselling.

The north Queensland boy, who is below the age of criminal responsibility, probably has no idea he has done wrong, state Opposition Leader Lawrence Springborg said today.

The eight-year-old was allegedly involved in the gang rape of the girl in Cairns 12 days ago.

Mr Springborg said the lack of counselling and monitoring could pave the way for similar acts by the same boy as he grew older.

"We have a time bomb waiting to happen again if there is no counselling," he told reporters.

An 11-year-old boy was scheduled to appear in the Cairns Children's Court today charged with rape and a 13-year-old boy has already appeared before a youth justice conference.

A police spokeswoman said the eight-year-old boy was too young to be charged.

Under Queensland law, children under 10 are not deemed to be criminally responsible.

But Mr Springborg said the law should be changed and the child should at least receive compulsory counselling.

"I was absolutely shocked that a child so young could be involved in such an horrific crime," Mr Springborg said.

"I was even more shocked as a parent that somebody that did that is not even counselled by the authorities - not even told that what they did is wrong."

i think this is utterly awful. they can't charge him or have him appear in court, but if that kid doesn't have to recieve counselling that is completely fucked.

that is so awful. It would be wrong for him not to get counselling. it seems like he really needs something to put him in jail would only give him opportunities to learn more "tricks of the trade".

i'm surprised that theres no way to insist on counciling...not quite same as charging, i'd thinkg

its very strange that this kid at this age would do something like this... he needs to get help or his parents need to be trialed

its unbelievable...maybe he was basically a bystander and the other boys encouraged it..a kid that old wouldnt have a clue,like would he even get erections yet?

a three year old girl..thats disgusting all three those boys should cop it bad..no matter how old they are especially the oldest two..

lets examine the situation:

u dont reach puberty till 13 i think so i dont think that any of the boys would have been desperate enough and attracted enough or something to rape a 3 year old.

where was the 3 year olds parents while these boys raped her. i mean shes only a baby and i dunno how long it takes to rape someone but im sure its not quick

the boys would have probably known this 3 year old girl for them to rape her. and i dont know anyone that rapes someone that they know. + u dont find 3 year girls on the street by them selves u know

i think thats enough points.

Not disagreeing with your other points, but the majority of rapes of kiddies usually involve people they know.

Er, 13 is not some "line in the sand" where suddenly you get erections.

Furthermore, the article never claims that the 8 year old was himself physically responsible or actually engaged in the rape - simply that he was involved. There is no suggestion that he has already commit the act, but rather that without counselling to teach him that it is SO FUCKING WRONG TO RAPE TODDLERS he is at much greater risk of doing so in future - when he has the physical capability to penetrate sweet toddler pie with his pulsing great manliness.

both people i know that've been raped were raped by by people they knew

i think ilja raises a really good point. Where were the parents of both the little girl and of the boy. Kids that yound arent usually just wandering about the streets. Not to fully blame the parents because what those boys did was totally wrong but they should have kept closer attention to their children. I wonder if anyone is investigating this??

You can't watch your children 24/7 - that's why parents try to raise their kids with their morals, so that the kids have an idea of their own that actions like this are wrong. And besides, what parent would want to think of their child - I must watch them, in case they rape that other kid???

Maybe the boy was too scared of the other two to say 'no!'?

thats awful, he needs to recieve counselling so he knows what happened and why it's wrong! i dont think he should be charged, as some other people have said he probably didnt know what he was doing and/or wasnt even directly involved in the rape. actually i think it highly unlikely that the boy actually raped the girl himself, but he witnessed it from two older boys who certainly knew what they were doing even if they didnt realise the full extent of their crime. he may have been too scared/horrified to stop them, maybe he didnt realise what they were doing. But what about the parents of these kids? something must have gone wrong somewhere for those boys to go and rape a 3 year old...most normal children have a strong sense of right and wrong hammered into them by that age and wouldnt even think about it. perhaps it was just curiosity gone wrong...althought they surely could have found out about sex in a less hands on way. whatever the truth is, its still sickening.

i dont think the article is telling it like it happened.

first of all can 3 yr olds even be penetrated? they mean rape as in penis in gina right? and why would a 13yr old be turned on by a 3yr old? he probably thought he was going to be all grown up and have sex like mummys and daddies do, but what kind of detail would they know?

my first reaction was this is fucked, but now my reaction is more along the lines of wonder and amazement that such a thing could happen, coupled with a desire to call bullshit, cause really we dont knonw much about what happened, they are children anyways, indentity protected by law and seen as there is no charge of rape in australia[only sexual assult] iam more inclined to beleive that the girls parents went apeshit when she found 3 older boys playing doctor on her toddlers privates, or tickling between her legs or something... i dont even wanna think about it, its that fucked, but keeping an open mind is the smart option
