i find it ridiculous that the government has been knowingly sitting on this issue for 15 years, and only now, very convieniently pre election, have they decided to do anything about it.
I am also confused of their reasoning behind sending countless military soldiers into a society and culture that we ourselves have destroyed by alienating them with foreign concepts such as alcohol & pornography- and expect to see everything changed by terrorising young children and increasing the sense of fear of another possible "stolen generation" scenario to arise.
However i suppose i shouldnt be surprised by such a move made by Mr Howard so close to an election that he knows he is losing.

... Except that customary law only applies when the offence is committed by an aboriginie against an aboriginie and so they receive 2 punishments, one off the white justice system and one off their own people.

It's such an outrage. Aboriginies getting away with crimes whilst everyone else doesn't. It's just.. Political correctness. It's just.. another slap in the face for us white middle class strugglers. We're always being put down. We're always struggling against this machine!

So you think customary law should be a mitigating factor in sentencing an aboriginal for a "customary" marriage with a 14 year old girl?

What does Customary marriage have to do with this?

softer sentences for serious crimes, ie. ones of violence, are given, because not only is the offender sent to jail for a few years, but he is also speared through the leg by his tribe upon release. It doesn't apply to crimes which don't exist in their society.

Mr Brough's comments come after an Aboriginal elder in the Northern Territory, who claimed customary law gave him the right to bash and have anal intercourse with a 14-year-old schoolgirl promised to him as a wife, lost a High Court bid to overturn his three-year jail sentence on Friday. Mr Brough said it was an outrage that the 55-year-old man was originally sentenced to just one month's jail by Northern Territory Chief Justice Brian Martin last August, after the judge accepted that the defendant believed tribal law gave him the right to teach the girl to obey him.

Customary law had nothing to do with that decision. And the judge would have found the same whether or not discounts were given for customary law mitigations.

The judge specifically cited tribal/customary law when discouting his sentence dumbass and the appeal court overturned the sentence.
