murder CAN get you more... it's just there's different types of muders too..

If someone left someone hanging by a hook thru their stomach in their basement, constantly whipped them untill they died.. i think they'd get life.

But if you shoot and kill someone that you've just had a fight with... out of anger... i mean yes it's bad and u need to be punished, but it doesn't really show that you are some sort of crazed killer that kills for fun or anything.

Gravity of the crime I believe it is called.

But the problem is just how many years they got, 55. The sentance for plain murder is 15 years I believe (IIRC). The rape, despite how bad it was, does not warrant such a discrepency. As said before, it was mainly a cave in to public pressure, rather than the actual crime that made it so.

Yea, I agree with Bone. The length of the sentence was utterly absurd.

They should keep them in the big house otherwise the public outcry from their release would see them be hounded day and night like that pedo up in queensland whos voluntary gone back to prison.

the reason for the long sentence was because of 'general deterrence' which means the govt and the justice system wanted to make an example out of the skaf case as to reduce sexual assault numbers. ie, if you know that agrivated sexual assault in company can result in a 55yr sentence you are less likely to committ the offence than if you got 20yrs (which i think it used to be)...and yes the govt changed the laws because of public outcry but usually judges don't impose the maximum sentence but i feel like the public outcry got the better hand of the legal system, so there was more rights for society than for the individual. However, what they did was sick and disgusting, and i'm sure the victim feels better that they got more time for doing the crime...i guess there are many ways of looking at it.

did he voluntarily go back?, i thought he was in police protection after being bashed...and generally rehabilitation dosen't work on serious indictable cases...so the big house is generally the sanction in rapes..

Seriously tho... as much as i see it that they could turn out to be ok members of society..
I just can't imagine making the 'mistake' of raping someone, u would need an EXTREMELY fucked up life before i even started thinking it was some sorta mistake that u may later have more morality against doing.

Basically, i fear that if they had a short sentence, as bad as going to jail for any time is... they would still have the morality that rape is ok.

Yeah, i agree, but they do have lives to- i mean like a family and people to look after....but i can't imagine that it was a 'mistake'- you know what you are doing and how it will affect people- it's not acceptable anyhere in the world, so why do it? And if you do commit a crime you have to face the music...

yeah i think its like 3/4 of your actual sentence, but not everyone gets parole, you have to apply to a board who decides...and sometimes a sentence is handed down with no parole...

look the retrial is being conducted because the laws concerning the jury's ability to undertake personal investigations were fucked up.
these guys were gang rapists...
1 out of 3 victims pulled out. imagine the other 2 they'd be like scared as shit.
whoever started this thread: wtf? go join them if u wanna get buttfucked.

Thats why there is laws in place against anyone with a connection to anyone involved in the matter from judging it.

Good thing the law is not up to you.

I am not argueing that they did not commit a crime. What i am saying is that 55 years is a rather extensive period when compared to what murderers and war criminals get.

Maybe there was a public outcry about the sentencing because the public heard things like "you Aussie pig", "give it to you leb style" etc etc. People watch shows like 60min and get upset :(

Crashoverride i agree with you, 55 years is relatively unduly harsh and there is little doubt in my mind that the change in legislation was a political ploy by the Carr govt to pander to popular public opinion.

Nevertheless, i think that all violent crimes should be punished far harsher and if they were i wouldnt see a problem with putting that disgusting, filthy, waste of life Scaff away for 55 years. In my opinion, the girl shouldnt hve to be put through that expereince again, of having to graphically describe what ahppened to her in front of a sneering accused and the mocking family of the accused. The previous transcripts should be enough and that bastard should rot in jail!

The main argument here seems to be 'well i think 55 years is ok, but it's less than some get for murder so that's not fair!'.

JUST because one judge made the mistake and allowed 1 murderer to get away with 20 years doesn't mean that someone that deserves 55 years for rape should get away with that too!

but thats the thing it isnt just one judge who is treating murder sentencing lightly it is a reflection on the judicial system as a whole which doesnt seem to value a persons life as much as it used to- but yeh i did say that 55 years is relatively harsh when u look at the average sentences for similar violent crimes. But i fully agree, anyone who does anything like that to another human deserves to rot in prison!
