we have 10 days for this one........which is like a tonne of time.

other times its been 4 days.

and i hear one for this other subject is a take home exam that is one day.

well my 13 weeks of bludging has caught up with me.

looks like question 2......i guess i will read all of week 5 for personal injury damages.

question 1 i will read week 6 and property damage. looks like evans balog and pantalone alouie thing. maybe. idunno. :confused:

i just don't wanna miss any causes of action or issues.

thats how i ended up with complete disaster in property hypothetical last semester.

time to go have a long night of reading.

then more reading 2morow.

then hopefully i can start.

Good luck! I've only started personal injury... restitution and property damage gave me such a headache, I hope personal injury will be easier. =/

i've pretty much finished, although no clapping since i should've been done two days ago - got an evil forecasting exam on thurs :bomb:

and yeah personal injury's easier in a way since you've seriously got crap all words so no time to do it properly - just chuck in a sentance or two about everything and u're set.

do u guys know if +10% applies?

i just finished restitution.....i think. question one is done (well the 15 mark part is).....i'm gonna have to cull though because i haven't even got on to the "other remedies".

which brings me to my question............other remedies?

and its the same with the 5 mark part in question 2.

policy considerations?

i read the 5 page policy thing regarding that wrongful birth case.................well that wasn't helpful.

thats what i thought........but then i was like......injunction......for something the rokov's shouldn't be doing anyway.

exemplary damages maybe.:confused: ............yeah.....that'd be great to bring up.

'one cause of action could be for exemplary damages......but since they have no chance in hell of getting them......they wont succeed'.

i think they'll give u a lot of room to move in policy considerations, everyone is going to be saying different ones - tests give so much room for judicial discretion there are heaps that can be brought in, just think of what broader social considerations may influence the outcome - doubt you'll go wrong

its ok i bullshitted abot that sort of stuff.

q2 is done.

its so cram packed.

but when i read over it........it doesnt really answer the questions enough.

theres just not enough room.

everthing is just done in brief.

oh well..........time for the 5 mark part in q1.

im gonna read over injunctions......and exemplary damages.......or whatever else i can to see if any apply.

and if they don't apply or even have any chance of succeeding.....fuck it i'll bring them up anyway and hope for the best.

injunctions is one. with a restriction to trespass.

bendal v mirvac p 733 in TNK.

good to use if the Rokov bastards still put the circus on the land even after the threat of damages.

not that the circus is of priority right now for the rokov's

but whatever.

i had to cull out a lot in the first question too. just to fit in something about alternative remedies.

i made these both 1250.

i sure as hell hope theres no 10% crap.

that 10% could have been mighty useful.
