the fact of the matter is, if one person is sober and the other is drunk, namely outside the context of an already established sexual relationship... the sober person has taken advantage of the drunk person. it's rape to have sex with someone who's mentally disabled, who's under the age of consent, etc etc - and the law says it's rape to have sex with someone whose judgement has been clouded thru intoxication.
