fairness doesn't change according to different legal systems

more like we are judging what is fair according to our individual perceptions of fairness

although i don't see how any person can see the death penalty for smuggling 4kg of marijuana as fair in any way

Ok maybe i should be saying that what we see as fair is based on the culture in which we live and this culture in turn shapes our legal system...

An individuals perception of fairness is shaped by the society in which they grew up, and a legal system should exist to reflect that societies overall idea of what is fair.

This is so fucking controversial that it takes me back to Lindy Chamberlain.

I would like to know everyone's opinions. If you believe in the innocence/guiltiness of Corby - what do you believe in the way of Chamberlain's case?
i think it's interesting how one side believes the other side of each respective case.
I realise that this is completely irrelevent but yet relative to our discussion of the Australian legal System.

i think it's interesting how one side believes the other side of each respective case.
I don't know enough about the Chamberlain case to have a real opinion on it.

Yes. They should be able to shape their society in any way they want. It's not as if it affects you in any way. You have the choice of not going there if you are against the way they work, just as schapelle had the choice whether to go to bali or not...

Lindy Chamberlain case opinions/discussion/questions.

As I believe her case reflects the controversial decision, however, by our legal system, rather than the Indonesian legal system.
Which is different as Chamberlain was not travelling to Indonesia at the time she/the dingo murdered her baby, but still, I would like to hear people's opinions on Chamberlain in comparison to their Corby opinions.

There are some obvious boundaries to that concept, but I don't think that 20 years is intrinsically wrong for what Schapelle has done, although many might disagree.
